1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of PAYZOWORK's website, platform, and services (collectively, the "Services"). By accessing or using our Services, you ("User," "you," or "your") agree to be bound by these Terms and our Privacy Policy.
Agreement Formation
These Terms form a legally binding contract between you and PAYZOWORK ("PAYZOWORK," "we," "us," or "our"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Modification of Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through our Services. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.
2. Definitions
Creator/Provider
User who uploads and delivers digital work through PAYZOWORK platform.
Client/Purchaser
User who purchases and accesses delivered digital work through PAYZOWORK.
Digital Work
Any digital file, content, or service delivered through PAYZOWORK platform.
Transaction Fee
5-10% fee charged by PAYZOWORK on successful payment transactions.
3. Eligibility & Account Registration
Eligibility Requirements
- You must be at least 18 years old or the age of majority in your jurisdiction
- You must have legal capacity to enter into binding contracts
- You must complete KYC verification as required
- You must provide accurate and complete registration information
Account Security
Your Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
Account Verification (KYC)
To use certain features, including payment processing and withdrawals, you must complete our KYC verification process. This may require submitting:
- Government-issued identification
- Proof of address
- Business registration documents (if applicable)
4. Services Description
Platform Role
Important: PAYZOWORK acts solely as a technology platform facilitating secure delivery and payment processing. We are not a party to any agreement between Creators and Clients. We do not guarantee the quality, accuracy, or legality of any Digital Work delivered through our platform.

- Payment-first delivery mechanism

- Secure link generation and management
- Transaction tracking and reporting
Supported File Types
- Documents (PDF, DOC, PPT, etc.)
- Design files (PSD, AI, FIGMA, etc.)
- Code repositories and archives
- Video and audio files
- Digital templates and assets
5. Fees & Payment Terms

Setup Fees
The transaction fee is deducted from the payment received before funds are released to the Creator. Fees are subject to change with 30 days notice.
Payment Processing
- All payments are processed through third-party payment processors
- PAYZOWORK does not store credit card or bank account details
- Payment processing fees may apply in addition to our transaction fee
- Funds are released to Creators after successful payment verification
Withdrawals
Instant Withdrawal: Creators can withdraw earnings instantly to their registered bank account after KYC verification. Minimum withdrawal amounts and processing times may apply based on your bank and location.
6. User Responsibilities
Creator Responsibilities
- Provide accurate descriptions of Digital Work
- Deliver work as described and agreed with Client
- Ensure Digital Work does not infringe third-party rights
- Maintain backup copies of all delivered work
- Comply with all applicable laws and regulations
Client Responsibilities
- Provide accurate payment information
- Review work requirements carefully before payment
- Use delivered work only as permitted by Creator
- Respect intellectual property rights of Creators
- Provide constructive feedback for dispute resolution
7. Prohibited Activities
Zero Tolerance: Violation of these prohibitions may result in immediate account suspension, termination, and legal action.
Prohibited Content
- Illegal or fraudulent goods/services
- Malware, viruses, or harmful code
- Copyright-infringing material
- Adult or explicit content
- Hate speech or discriminatory material
Prohibited Conduct
- Attempting to bypass payment system
- Creating multiple accounts to avoid restrictions
- Harassment or abuse of other users
- Reverse engineering or scraping platform
- Misrepresenting identity or qualifications
8. Intellectual Property Rights
Creator Rights
Retention of Rights: Creators retain all intellectual property rights to their Digital Work. PAYZOWORK claims no ownership over the content you deliver through our platform. Delivery through PAYZOWORK does not transfer any intellectual property rights to Clients unless explicitly agreed between Creator and Client.
Platform Rights
PAYZOWORK and its licensors own all intellectual property rights in:
- The PAYZOWORK platform, software, and technology
- Trademarks, logos, and branding
- Documentation, tutorials, and support materials
- Aggregated, anonymized usage data and analytics
License to PAYZOWORK
By uploading Digital Work, you grant PAYZOWORK a limited, worldwide, non-exclusive license to host, store, encrypt, and transmit your Digital Work solely for the purpose of providing the Services to you and facilitating delivery to your Clients.
9. Disclaimer of Warranties
As-Is Basis: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PAYZOWORK MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Specific Disclaimers
- We do not guarantee uninterrupted or error-free service
- We do not guarantee the quality, accuracy, or legality of Digital Work
- We do not guarantee successful payment collection
- We do not mediate disputes between Creators and Clients
- We do not guarantee compatibility with all devices or browsers
10. Limitation of Liability
Cap on Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYZOWORK'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO PAYZOWORK IN THE SIX MONTHS PRECEDING THE CLAIM.
Excluded Damages
IN NO EVENT SHALL PAYZOWORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
11. Termination
By User
You may terminate your account at any time by contacting support@payzowork.com. Upon termination, you remain responsible for any fees or charges incurred prior to termination.
By PAYZOWORK
We may suspend or terminate your account immediately if you violate these Terms. We may also terminate accounts that are inactive for 12 months or more.
Effect of Termination
Upon termination: (1) Your right to use the Services ends immediately; (2) You must cease all use of the Services; (3) We may delete your account information and stored files; (4) Any outstanding payments will be processed according to our standard procedures.
12. Dispute Resolution
Governing Law
These Terms and Conditions shall be governed and construed in accordance with the laws of India. Any disputes arising out of or relating to the use of this website or services shall be subject to the applicable laws of India.
Dispute Resolution & Jurisdiction
In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the user agrees to first attempt to resolve the matter by contacting our support team at support@payzowork.com.
If the dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts located in Shakti Chhattisgarh, India. The place of jurisdiction shall be Shakti, India.
Class Action Waiver
YOU AND PAYZOWORK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by PAYZOWORK, constitute the entire agreement between you and PAYZOWORK.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary.
